If I know for sure that I will only get GC after a decade or so, I might as well go back. With 3300 visas for EB3-I, one decade for the PD to reach 2004/2005 seems very likely.
There are still lots of cases in eb3 from back that far.
Many of the eb3 245i cases; there dependents were outside USA. Once; they got greencards; then their dependents went for consular processing or are going for consular processing.
One of the cases I worked on ability to pay; person had adopted her nephew so that he could get greencard as dependent. You couldn't even begin to imagine how many cases like this there are.

Atlast all my checks are cashed today. I am able to get my case number from the checks. Even though INS received my application on June 6th, in my 485 it says that they have received my application only on June 11th. Wonder why?

After 6-7 months tell the employer that i'm going India for ever due to personal reasons - you know its not feasible for me to pay.
They can't cancel 140 after 6 months from approval ( or can they?) , they can't substitute the labor because its already used and July 17th has passed.
Then I actually go back to India , spend some time , come back silently because i have a EAD and AP.

No one can force you to work for them. If there is no breakage clause, then the agreement will not stand in court. Issue is when there is a breakage clause. If there is a breakage clause, you may either have to fight it or suck it up and pay the amount (as long as it is a basis for the amount - just saying "pay $10K if you leave the job" will not stand in court either).

Last Friday I called Customer Service Center and told them that I did not get FP and Biometrics .I used the words that I was depressed ,worried and all others who applied after me got FP but I did not get it ,my son going to be 21etc .......Finally Male IO scheduled FP immediately for me and my family on May 16.I saw LUD on Friday itself and another Lud on sunday ,today I got the letter.

I am a 2 July 2007 filer. Many SR's and calls later no FP.But I applied for EAD and AP renewal last week.I got the FP notice in mail today.
So I think that the renewal may trigger a FP notice.

I was working on DC but so far just received 30 votes..
Like I said I will talk to core members if only we have 1000 members who wants to do it in DC on July 14th.. So many members are online but they don't even want to take a poll.. I don't know what to expect from members..

That is a good start. We had around 14 people on 07/07 demonstration but it was fun. Thirty is double that. I will keep you posted on what strategy we are following in Bay area. I will also request the Chinese member to post about the local event in DC once we finalize the logistics today evening.

I think we should write in only one thread about this VB mess until it is over. New users like me are getting hard time to find out the latest development of the VB issue. My 15 yr old was the first to receive the notice. She was not in US at that time. I called the USCIS and informed them about this. They said they will postpone the appointment. But the postponement was only for 2 weeks. With the next notice I went to the local office. The security officer gave me a print out stating that I visited there for this reason. AND ACCORDING TO THAT NOTICE, FINGER PRINTING CAN BE DONE WITHIN 64 DAYS FROM THE ORIGINAL NOTICE. My child came back to US in 60 days and I took her to the local office walk in date. He got finger printed.
The very next week my 9 yr old got the notice. I took another appointment and next day I got a second finer printing notice for my elder one again. I took both of them to the local office and explained the situation. For my second child they did the finger printing and for my elder, they made a stamp on to the latest notice which was not at all clear.
Me and wife was never requested for a second finger printing. We all just got GREENED on August 6th.

Is there premium for I485?

IF you are in such a big hole, you will have to come forward and work for yourself. We want others to work for us and solve our problems. That is my issue here. With 11.25 K EB3 members we would have still collected quarter million bucks.(@ 25$/person) If EB3-I does not care for itself, why would anybody else give a damn? (PS : I did contribute for the drive as I want everybody's issues with respect to GC resolved, not just mine)
So, the original post still stands true.
Problem was ours (EB2 & EB3) and we fought together until EB2&EB3 dates were retrogressed.Now the problem is only for EB3s so EB3s only have to come forward and work for ourselves. Thank you Sir...

Another way is to ask the question in Rajiv Khanna's forums. Again, if a couple of people ask the same question, the question will get prominence and Mr. Khanna would definitely answer the question.
Did any one discussed this with an attorney. May be a conference call with Mr. Rajiv Khanna ? Can anyone from IV core member respond what is their take on such a class action. Will we have the support from IV if such lawsuit is filled.
Again i strongly believe our only way out of this mess especially for EB3 India is lawsuit.

No worries sathweb.. We all are in the same situation and at times things happen. Our mission is one: GC or no GC, we also deserve peace of mind. GC is just a means, not the final destination. :)
